Why we have
discontinued our OPI collections . . .
Dear Nail
Polish Diva Customers:
We have noticed
over the past few months that OPI (the actual company) has
bullied a lot of other ecommerce sites into taking their
products off their web site. After further
investigation, they are pressing charges against a few.
OPI has even gone so far as to bully the BLOGGERS, most
being single mommas, teens and polish-holics, that have
become a fan of OPI over the years. They have made
these individuals take down all the pictures and their
trademark polish names. For example, they are suing
(or threatening to sue) one for just stating "I'm Really Not
A Waitress".
Yet, the
retailers they ARE NOT bullying are the big wigs like
Amazon, Target, JC Pennys, Meyers (sp?) and other giant
companies for having their nail polish on the shelves.
Imagine that. Yet they claim their mission is to sell
to Salons only. I can even go into the mall where a
Sally's is located and buy a brand new bottle of OPI nail
polish.
We have
discussed our options and have decided we do not want to
risk OPI coming after us. If they take it all, and we
think they will try, we will end up with nothing. We
would not be able to support our children. What does
OPI care, right? We can at least salvage what we can
now and rebuild.
In 2006, we
owned a web site OPIDiva.com. The original reason we
started the site was because one of our employees bought a
USED bottle of nail polish off of Ebay for $12.00. I
couldn't believe it. So, I contacted OPI and designed
a web site completely around their product line. In
2008, OPI's lawyer contacted me and said that my site was
infringing trademark because of the web site's name.
Fine . . . we moved it. They had me sign documentation
saying that I would not publish to that site again.
Now why didn't they say something two years ago?
I've read on a
blog that some of the ecommerce sites received a letter from
the same lawyer in November 2009 telling them to stop
selling online. Why didn't we get one? Could it
be because we sell more OPI than any other ecommerce sites?
Probably.
Regardless,
OPI obviously doesn't want YOUR business nor ours.
We have never acted like we were OPI nor an actual OPI
distributor. We bought our OPI through other retailers
just like you. The reason our site did so well was due
to the fact that we had almost EVERY OPI nail polish color.
Our OPI was not and is not FAKE. It is the original
OPI nail polish.
We understand
to an extent WHY OPI is doing this. Some sites were
undercutting the cost of the polish so much that a salon
could go online and buy it cheaper than from a distributor.
But going as far as going after the little guys who has
made OPI the company that OPI is now is just not fair and
UNWISE. So, OPI, if you are reading this - you might
want to check out the blogs too. WE (other ecommerce
sites and bloggers) made you what you are now. You
just shot yourself in the foot.

We will be taking the OPI nail polish lines down as we sell
out of them. In its place, we will be offering other
great nail polish lines. We would love to hear from
you. Good or bad, we would love to hear your opinion
regarding how they compare to OPI. We would also love
to hear your recommendations. We will be working on a
big discount for all of our current customers. We do
